Terms of Service

Momentum Worldwide Movers Company, Ltd.

​1. Introduction

These Terms of Service (“Terms”) govern the provision of moving, relocation, and related services by Momentum Worldwide Movers Company, Ltd. (“we,” “us,” “our”) to you (“you,” “your,” “customer”). By requesting or accepting a quotation, booking, or service from us, you agree to these Terms.

 

2. Scope of Services

We offer international and domestic moving services, including but not limited to:

  • Packing and unpacking

  • Transportation of household goods, personal effects, and office items

  • Storage (short-term and long-term)

  • Customs clearance assistance

  • Destination services (e.g., housing search, settling-in assistance)

  • Specialty handling (e.g., fine art, antiques, vehicles)

The specific services we will provide will be set out in your quotation and confirmed booking.

 

3. Quotations

3.1 Validity – Quotations are valid for 30 days from the date issued unless otherwise stated.

3.2 Basis – Quotations are based on the information you provide regarding the items to be moved, locations, and services required.

3.3 Adjustments – The final charges may change if:

  • Additional items or services are requested,

  • Access to premises is restricted or different from described,

  • Customs or third-party charges change.

3.4 Currency – Unless otherwise stated, all prices are in Japanese yen (JPY) and include applicable taxes.

 

4. Booking and Payment

4.1 Booking Confirmation – A booking is confirmed only after you accept the quotation in writing (email confirmation is acceptable) and pay any required deposit.

4.2 Deposit – We may require a deposit before services are scheduled.

4.3 Payment Terms – Full payment is due as per the invoice terms, usually before shipment or delivery, unless otherwise agreed in writing.

4.4 Late Payments – Late payments may result in storage charges, interest, or delay of services.

 

5. Customer Responsibilities

You agree to:

  • Provide accurate information regarding your goods and relocation details,

  • Ensure all goods are ready for collection at the agreed date/time,

  • Obtain any necessary permits or approvals for access,

  • Ensure goods do not include prohibited or hazardous items (as per Japanese and destination country law),

  • Complete all required customs documentation accurately and truthfully.

 

6. Packing and Inventory

6.1 Packing by Us – If we pack your goods, we will do so with professional care using appropriate materials.

6.2 Packing by You – If you pack your own goods, you are responsible for ensuring they are packed securely. We may not accept

liability for damage to owner-packed items.

6.3 Inventory – An inventory list may be prepared for customs and tracking purposes.

 

7. Insurance

7.1 Coverage Options – We offer optional transit insurance for your shipment.

7.2 Exclusions – Insurance coverage is subject to the terms of the insurer and may exclude certain items or causes of loss/damage.

7.3 Claims – Any claims must be made in writing within the time limits set by the insurer.

If no insurance is taken, our liability will be limited as set out in Section 8.

 

8. Liability

8.1 Standard Liability – If we are legally liable for loss or damage to your goods, our liability will be limited to [e.g., ¥10,000 per item or carton], unless otherwise agreed in writing.
8.2 Exclusions – We are not liable for:

  • Loss or damage caused by events beyond our control (force majeure),

  • Inherent defects in goods,

  • Changes in climate, humidity, or temperature,

  • Loss or damage to owner-packed items, unless due to our negligence.

8.3 Delays – We are not liable for delays caused by customs, port congestion, weather, or other factors outside our reasonable control.

 

9. Storage

If storage is arranged:

  • Charges will be invoiced monthly unless otherwise agreed,

  • Access to stored goods must be arranged in advance,

  • Stored goods must be insured by you or under our storage policy (if available).

 

10. Cancellations and Postponements

10.1 Notice – Cancellations or postponements must be made in writing.

10.2 Fees – Charges may apply based on costs incurred, including deposits, third-party fees, and any work already performed.

 

11. Customs and Regulatory Compliance

You are responsible for ensuring that all items comply with import/export regulations in Japan and the destination country. We will assist with documentation but are not responsible for fines, delays, or confiscations caused by inaccurate or incomplete information.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes will be subject to the exclusive jurisdiction of the Tokyo District Court, unless otherwise required by law.

 

13. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your confirmed booking will apply to your move.
